Several days ago, unbeknownst to all Parties involved and after 9 years of litigation, Chief Counsel Joshua Prince of the Firearms Industry Consulting Group (“FICG), a division of Civil Rights Defense Firm, P.C., secured a major victory against the City of Harrisburg’s illegal firearm ordinances in Firearm Owners Against Crime – Institute for Legal, Legislative and Educational Action, et al. v. City of Harrisburg, et al., 2015-CV-354 (Dauphin County Court of Common Pleas).

In a September 27, 2024 decision, Judge Dowling granted a permanent injunction enjoining the City’s enforcement of its Parks, Lost and Stolen, Discharge, and Minors ordinances, as they unlawfully regulate firearms and ammunition in this Commonwealth. While he questionably found that the Plaintiffs lacked standing to challenge the emergency ordinance, as he contended that it has never been triggered (even though the preclusion is automatic based on the issuance of a declaration of emergency by the Mayor), in a footnote, he noted that if ever triggered, the emergency ordinance would likewise be preempted.
