Today, Chief Counsel Joshua Prince of the Firearms Industry Consulting Group (“FICG), a division of Civil Rights Defense Firm, P.C., filed a letter on behalf of Firearm Owners Against Crime – Institute for Legal, Legislative and Educational Action (FOAC-ILLEA) with Pen Argyl Mayor Male and Borough Council regarding their recent consideration and adoption of an unlawful and unconstitutional firearm discharge ordinance.

As addressed in FOAC-ILLEA’s letter to Mayor Male and Borough Council, in direct defiance of the legion of precedent from the Pennsylvania Supreme and Commonwealth Courts, the proposal seeks to regulate the discharge of firearms in the Borough. As our viewers may remember, in Firearm Owners Against Crime, et al v. Lower Merion Township, the Commonwealth Court ruled that discharge provision are preempted under Pennsylvania’s firearm and ammunition preemption statutes.

As this ordinance constitutes a criminal offense, FOAC-ILLEA is prepared to file private criminal complaints with Northampton County District Attorney Stephen Baratta if the Ordinance, and any other illegal firearm regulation, is not immediately repealed.

Please join me in thanking FOAC-ILLEA for always remaining steadfast in its dedication to defending Article 1, Section 21, 18 Pa.C.S. 6120 and the Second Amendment. I would highly encourage anyone in a financial position to do so, to donate to FOAC-ILLEA so it can continue to support important litigation defending our Rights.

If your state or federal constitutional rights have been violated, contact FICG today to discuss your options.
